Làm quá hạn hợp đồng mà công ty không ký hợp đồng mới

Tôi làm việc cho một công ty cổ phần tư vấn đầu tư tôi có hợp đồng lao động xác định thời hạn một năm. hiện nay tôi đ ã quá hạn hợp đồng 4 tháng công ty vẫn chưa làm hơp đồng mới cho tôi . Vì công ty rơi vào tình trạng khó khăn  nên giờ tự nhiên làm hợp đồng lao động 6 tháng . Vậy tôi hỏi công ty tôi là như vậy có đúng không?

 Theo quy định tại Điều 27b Bộ Luật lao động thì đối với HĐLĐ xác định thời hạn trong thời hạn 30 ngày kể từ ngày HĐLĐ hết hạn nếu người lao động vẫn tiếp tục làm việc thì hai bên phải ký HĐLĐ mới. Nếu không ký thì HĐLĐ đã ký trở thành HĐLĐ không xác định thời hạn.
 
Căn cứ vào quy định này thì HĐLĐ của bạn với công ty đã trở thành HĐLĐ không xác định thời hạn. Do đó, công ty không thể ký HĐLĐ có thờ i hạn 6 tháng với bạn nếu không được bạn đồng ý./.
